1Locol Technologies LTD Registered in Ireland · CRO No. 822728 69 The Junction The Crossings Lucan, Co. Dublin Ireland K78 T6W8
These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and 1Locol Technologies LTD concerning your access to and use of the Services.
By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Legal Terms.
If you do not agree with these Legal Terms, you must not use the Services.
We may update these Legal Terms from time to time where reasonably necessary for legal, regulatory, security, technical, product, or operational reasons.
Where required by applicable law, we will provide reasonable prior notice of material changes by email, through the Services, or by another appropriate means. Changes will take effect on the date stated in the relevant notice.
Any modification affecting a continuing paid digital service is also subject to the protections in Section 14, including any applicable right to terminate the affected service without charge.
Nothing in an updated version of these Legal Terms will remove or limit rights that cannot lawfully be excluded or restricted.
The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to register for or use the Services unless expressly permitted by applicable law and by 1Locol.
We recommend that you retain a copy of these Legal Terms for your records.
1. OUR SERVICES
The Services may be subject to applicable laws and regulations relating to consumer protection, data protection and privacy, telecommunications and eSIM services, travel services, and payment-related services.
Certain regulated financial, payment, identity-verification, telecommunications, or connectivity services made available through the Services may be provided by independent third-party providers responsible for complying with the regulatory requirements applicable to the services they provide.
When you purchase an eSIM plan directly from 1Locol, your contract for that plan is with 1Locol Technologies LTD. We may use independent connectivity providers, mobile network operators, and roaming partners to provision and deliver the underlying connectivity. Unless expressly stated at checkout, those providers are not the seller of the eSIM plan to you.
Nothing in these Terms should be interpreted as representing that 1Locol holds a regulatory licence or authorisation unless expressly stated.
1Locol remains responsible for complying with the legal and regulatory obligations that apply directly to the Services and activities that 1Locol itself provides.
2. INTELLECTUAL PROPERTY RIGHTS
Our intellectual property
We own or license the intellectual property rights in the Services, including source code, databases, functionality, software, website designs, text, graphics, photographs, video, audio, trademarks, service marks, and logos.
These materials are protected by applicable copyright, trademark, intellectual-property, and unfair-competition laws.
Subject to these Legal Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use or legitimate internal business use.
Except where expressly permitted by these Terms, applicable law, or our prior written consent, you may not copy, reproduce, republish, distribute, sell, license, publicly display, transmit, modify, or commercially exploit our Content or Marks.
Nothing in these Terms transfers ownership of 1Locol’s intellectual property to you.
Submissions and feedback
If you send us questions, comments, suggestions, ideas, feedback, or similar submissions regarding the Services, you grant us permission to use them for the purposes of developing, improving, operating, and promoting our products and services without compensation to you.
This does not transfer ownership of other content or intellectual property that you otherwise own.
You must have the right to provide any information or material you submit and must not submit material that violates applicable law or the rights of another person.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- information you provide is true, accurate, current, and complete;
- you will keep relevant account information reasonably up to date;
- you have legal capacity to agree to these Terms;
- you meet the applicable minimum age requirements;
- you will not access or use the Services through unauthorised automated means;
- you will not use the Services for unlawful or unauthorised purposes; and
- your use of the Services will comply with applicable law.
We may restrict or suspend access where information provided is materially false, misleading, incomplete, or creates a security, fraud, legal, or compliance risk.
4. USER REGISTRATION
You may be required to register for an account to use certain Services.
You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to secure your account.
You must notify us promptly if you suspect unauthorised access to or use of your account.
We may require you to change a username or other account identifier where reasonably necessary for security, legal, operational, or abuse-prevention reasons.
5. PURCHASES AND PAYMENT
We may accept payment methods including Visa, Mastercard, and any other payment methods displayed to you at checkout.
Unless expressly stated otherwise, customer-facing prices and payments are denominated in the fiat currency displayed at checkout.
Stablecoins or other digital assets used by 1Locol or its service providers for internal settlement or infrastructure purposes are not customer payment methods unless expressly offered to you as such.
You agree to provide current, complete, and accurate information necessary to complete your purchase.
Prices may include applicable VAT, sales tax, or similar taxes where required. Any taxes or charges applicable to a transaction will be disclosed as required by applicable law.
You authorise the applicable payment service provider to charge your selected payment method for the amount displayed and agreed at checkout.
We may correct obvious pricing or technical errors. If an error affects a purchase you have already made, we will deal with the transaction in accordance with applicable consumer law and will not charge you a higher amount without your agreement.
We may refuse, restrict, or cancel an order where reasonably necessary because of:
- suspected fraud or abuse;
- payment failure;
- sanctions or compliance restrictions;
- product or service unavailability;
- technical error;
- applicable provider restrictions; or
- legal or regulatory requirements.
Any refund or cancellation rights are governed by our Refund Policy and applicable law.
eSIM plan terms
All eSIM plans sold by 1Locol are data-only. They do not include voice calls or customer-originated SMS. Any technical ability to receive a network or service message is incidental, is not part of the purchased plan, and is not guaranteed.
1Locol does not sell unlimited-data plans. Each plan has a stated data allowance and validity period. The plan ends when the included data allowance is consumed or the validity period expires, whichever occurs first. For a plan with a daily allowance, data service stops when that day’s allowance is consumed and may resume only at the next daily reset while the plan remains valid. Unused data does not roll over or have a cash value and expires when the plan ends, without affecting any statutory right or remedy.
You must activate the eSIM plan within the activation period shown before purchase and in your order confirmation. The period varies by plan, begins when the purchase is completed, and provides up to the displayed number of days for activation. If you do not activate the plan within that disclosed period, the plan expires, cannot be activated, and its unused data allowance is forfeited. The expired plan and unused allowance do not roll over, have no cash value, and do not by themselves entitle you to a refund. Any refund, cancellation right, or statutory remedy remains governed by our Refund Policy and applicable law.
Reinstallation or transfer to another device is subject to the technical capabilities and availability of the applicable connectivity provider, device, and operating system and is not guaranteed. If reinstallation or transfer works, you may continue using the plan on the supported device. Deleting an eSIM does not pause or extend its validity period and does not guarantee that 1Locol or the connectivity provider can issue a replacement profile.
Top-ups are not offered through the 1Locol website. After the 1Locol mobile application launches its top-up feature, a top-up may be offered there only for an eligible plan and will be subject to the price, allowance, validity extension, provider availability, and other conditions displayed before that top-up is purchased.
The plan summary shown before purchase forms part of your contract and specifies the data allowance, plan-validity period, activation period, the event that starts the validity period, coverage area, available network information, price, and any other plan-specific conditions.
6. PROHIBITED ACTIVITIES
You may not use the Services for any purpose other than that for which they are made available.
You must not:
- systematically retrieve or scrape data from the Services without authorisation;
- trick, defraud, or mislead us or other users;
- circumvent security controls, technical restrictions, usage limits, or verification requirements;
- harass, abuse, threaten, or unlawfully harm another person;
- submit false reports or misuse customer-support channels;
- use the Services unlawfully;
- upload or distribute malware, viruses, or harmful code;
- interfere with or disrupt the Services or connected systems;
- impersonate another person;
- create accounts using false identities or automated means;
- collect usernames, email addresses, or other personal information for unsolicited communications;
- reverse engineer, decompile, or disassemble software except to the extent expressly permitted by applicable law;
- engage in fraud, money laundering, sanctions evasion, payment abuse, or other unlawful financial activity;
- create, sell, transfer, or operate accounts for fraudulent or abusive purposes;
- engage in SIM farming, account farming, artificial network traffic, or similar abuse;
- resell or redistribute an eSIM, connectivity service, account, or other service unless expressly authorised;
- circumvent transaction limits, identity-verification requirements, geographical restrictions, provider restrictions, or security safeguards;
- use payment instruments or accounts without proper authorisation;
- engage in spam, malicious network activity, or abusive communications; or
- use the Services in breach of applicable third-party provider rules or applicable law.
7. USER CONTENT
The Services do not currently provide a general public feature that allows users to publish content for other users.
You may nevertheless provide information or materials to 1Locol through customer support, feedback tools, reviews where available, document-upload functionality, or other features of the Services.
You must have the right to provide any material you submit and must not submit material that:
- violates applicable law;
- infringes another person’s intellectual property, privacy, or other rights;
- is fraudulent, malicious, threatening, or abusive; or
- contains malware or other harmful code.
Personal data contained in submitted materials will be processed in accordance with our Privacy Policy.
8. REVIEWS
If the Services allow you to submit a review or rating, your review must reflect your genuine experience and must not be false, misleading, fraudulent, abusive, discriminatory, defamatory, or otherwise unlawful.
We may moderate or remove reviews where reasonably necessary to enforce these Terms, comply with law, protect users, or maintain the integrity of the Services.
Where required by law, any material commercial relationship associated with a testimonial, review, or endorsement will be disclosed.
9. MOBILE APPLICATION LICENCE
Your use of the 1Locol mobile application is also governed by our separate End User Licence Agreement (EULA).
Where these Terms and the EULA address the same software-licensing matter, the EULA will govern that matter.
For applications downloaded through Apple’s App Store, Apple and Apple’s subsidiaries may have third-party-beneficiary rights to the extent required by Apple’s applicable terms.
Google is not a party to these Terms and has no obligations under them except to the extent expressly provided under applicable Google Play terms.
10. THIRD-PARTY WEBSITES AND SERVICES
The Services may include links to, integrations with, information from, or access to products and services provided by independent third parties.
Third-party providers may apply their own:
- terms and conditions;
- eligibility requirements;
- availability conditions;
- limits;
- privacy practices; and
- regulatory requirements.
1Locol is not responsible for the acts or omissions of an independent third party solely because its service is accessible through 1Locol.
However, nothing in this section excludes any responsibility that 1Locol has under applicable law or under a contract where 1Locol is legally responsible for the relevant service.
11. SERVICES MANAGEMENT
We may monitor use of the Services to protect security, enforce these Terms, prevent fraud and abuse, comply with law, and maintain the proper operation of the Services.
Where reasonably necessary, we may restrict access to content, accounts, transactions, or functionality that:
- breaches these Terms;
- creates a material security or fraud risk;
- violates applicable law;
- interferes with the Services; or
- materially affects other users or third-party providers.
12. PRIVACY POLICY
Please review our Privacy Policy at:
Our Privacy Policy explains how we collect, use, share, retain, and protect personal data, including where personal data may be processed internationally.
International transfers of personal data are governed by our Privacy Policy and applicable data-protection law and do not depend solely on a user’s contractual consent to these Terms.
13. TERM, SUSPENSION AND TERMINATION
These Legal Terms remain in effect while you use the Services.
We may restrict, suspend, or terminate access to all or part of the Services where reasonably necessary because:
- you materially breach these Terms;
- we reasonably suspect fraud, abuse, or unlawful activity;
- your use creates a material security, legal, compliance, or operational risk;
- a payment, telecommunications, identity-verification, or other service provider requires restriction of the relevant service;
- we are required to do so by law or regulatory obligation; or
- the relevant Service is discontinued.
Where required by applicable law and reasonably practicable, we will provide notice and an opportunity to remedy a breach before termination.
Termination does not affect rights or obligations arising from transactions completed before termination.
Nothing in this section limits statutory consumer rights.
14. MODIFICATIONS AND SERVICE AVAILABILITY
We may update, modify, suspend, or discontinue features of the Services where reasonably necessary for product, technical, security, legal, regulatory, or operational reasons.
Where we modify a continuing paid digital service beyond what is necessary to keep it in conformity with the contract, the modification will be made for one of the reasons stated above and without additional cost to you.
We will inform you clearly of the modification. If it negatively affects your access to or use of the service beyond a minor degree, we will notify you reasonably in advance on a durable medium of the nature and timing of the modification and of your right to terminate the affected service without charge, unless we enable you to retain the unmodified service without additional cost and it remains in conformity with the contract.
Where that termination right applies, you may exercise it by contacting us within 30 days after the later of receiving the advance notice or the modification taking effect. We will provide any reimbursement or other remedy required by applicable law.
Where 1Locol expressly provides an uptime or availability commitment for a particular Service, that Service will be provided in accordance with that commitment and its stated exclusions.
Any such availability commitment applies only to the Service for which it is expressly stated and does not automatically extend to independent mobile networks, roaming providers, payment networks, telecommunications providers, or other third-party infrastructure.
Where no specific availability commitment applies, we aim to provide the Services reliably but do not guarantee uninterrupted or error-free operation.
Nothing in this section limits rights or remedies that cannot lawfully be excluded.
15. GOVERNING LAW
These Legal Terms are governed by the laws of Ireland, without regard to conflict-of-laws rules.
If you are a consumer resident in another country, you retain the benefit of any mandatory protections available to you under the laws applicable to your country of residence that cannot lawfully be excluded or limited by agreement.
16. DISPUTE RESOLUTION
We encourage you to contact us first so that we can attempt to resolve any complaint informally.
These Terms do not require you to submit a dispute to mandatory arbitration.
Subject to applicable consumer law, the courts of Ireland will have jurisdiction over disputes arising from these Terms.
If you are a consumer resident in another country, you retain any mandatory right to bring proceedings before a court or other competent forum available to you under applicable law.
EU consumers can also obtain information about available alternative dispute-resolution bodies through the European Commission’s Consumer Redress resources.
17. CORRECTIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, availability, or other information.
We may correct such errors and update information where reasonably necessary.
Where an error affects an existing paid transaction, we will handle the matter consistently with applicable consumer law.
18. DISCLAIMER
We aim to provide the Services accurately, securely, and reliably.
General informational content made available through the Services may depend on third-party sources and may change over time.
To the maximum extent permitted by applicable law, we do not guarantee that general informational content will always be complete, current, or error-free.
Nothing in these Terms excludes or limits:
- statutory consumer rights;
- contractual commitments expressly made by 1Locol;
- liability for fraud or fraudulent misrepresentation;
- liability for death or personal injury caused by negligence; or
- any other liability that cannot lawfully be excluded.
Where you purchase a product or Service from 1Locol, your statutory rights and the specific terms applicable to that purchase take precedence over any inconsistent general disclaimer.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, 1Locol will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the relevant contract was entered into.
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by negligence;
- breach of statutory consumer rights;
- any liability relating to personal data that cannot lawfully be limited; or
- any other liability that cannot lawfully be excluded or limited.
20. INDEMNIFICATION
If you use the Services primarily for personal purposes as a consumer, you will only be responsible for losses caused by your unlawful conduct or material breach of these Terms to the extent permitted by applicable law.
If you use the Services on behalf of a business, you agree to indemnify 1Locol against reasonable third-party claims, losses, and costs resulting directly from:
- your material breach of these Terms;
- your unlawful use of the Services; or
- your infringement of another person’s intellectual-property or other legal rights.
Nothing in this section requires a consumer to indemnify 1Locol for matters for which such an obligation would be unfair or unenforceable under applicable law.
21. USER DATA
We process and protect personal data in accordance with our Privacy Policy.
We take reasonable measures designed to maintain the integrity and availability of data associated with the Services.
You remain responsible for maintaining copies of information that you independently need to retain, where appropriate.
Nothing in this section excludes responsibility for data loss, corruption, or security incidents to the extent that 1Locol is responsible under applicable law.
22. ELECTRONIC COMMUNICATIONS
You agree that we may provide contracts, transaction confirmations, notices, disclosures, receipts, and other communications electronically where permitted by applicable law.
Electronic communications may be provided through the Services, by email, or through another electronic method you have agreed to use.
Nothing in this section requires you to waive any statutory right relating to the form, delivery, retention, or accessibility of a legal notice or document.
23. CALIFORNIA USERS AND RESIDENTS
If you are a California resident, you may have additional rights under applicable California consumer and privacy laws.
Information about privacy rights is provided in our Privacy Policy.
Where required by California law, complaints concerning consumer matters may also be directed to the appropriate California consumer-protection authority.
24. MISCELLANEOUS
These Legal Terms, together with our Acceptable Use Policy, End User Licence Agreement (EULA), Refund Policy, and any product- or order-specific terms presented to you, constitute the agreement governing your use of the Services. Our Privacy Policy explains how we handle personal data but does not reduce your contractual or statutory rights.
Related terms and order of precedence
If two documents conflict, any mandatory requirement of applicable law prevails. Subject to that requirement:
- product- or order-specific terms control for the product or order to which they relate;
- the EULA controls software-licensing and use-of-application matters;
- the Refund Policy controls our voluntary cancellation and refund rules, but does not limit statutory cancellation rights or remedies;
- an independent provider’s terms control only that provider’s underlying service where those terms were disclosed and apply to you;
- the Acceptable Use Policy controls acceptable-use matters; and
- these Legal Terms control all other matters concerning the Services.
No independent provider’s terms replace or reduce an obligation that 1Locol owes you as the contractual supplier of an eSIM plan purchased directly from 1Locol.
If any provision is invalid or unenforceable, the remaining provisions will continue to apply.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
We may assign our rights or obligations where permitted by law, including as part of a merger, restructuring, financing, or sale of the business.
Nothing in these Terms creates a partnership, employment relationship, fiduciary relationship, or agency between you and 1Locol.
Nothing in these Terms waives a consumer right or legal defence that cannot lawfully be waived.
25. THIRD-PARTY REGULATED AND CONNECTIVITY SERVICES
Certain services made available through 1Locol may be provided, operated, or fulfilled by independent third-party providers, including:
- payment service providers;
- identity-verification providers;
- eSIM and telecommunications providers;
- mobile network operators;
- roaming partners; and
- other regulated or specialised service providers.
Where a third party provides the underlying regulated, financial, telecommunications, connectivity, or other specialised service, that provider may apply its own eligibility requirements, service terms, limits, compliance requirements, availability conditions, and regulatory obligations.
For eSIM plans purchased directly from 1Locol, 1Locol remains the contractual supplier even where an independent provider provisions or delivers the underlying connectivity.
Nothing in these Terms should be interpreted as representing that 1Locol holds a regulatory licence or authorisation unless expressly stated.
Nothing in this section limits any responsibility that 1Locol has under applicable law or under a contract where 1Locol is legally responsible for the relevant service.
